Payment Terms*
All packages that are ordered are charged the total
package price upon placement of the order.
Cancellation
In the event of cancellation of this project, Lucky Dog, LLC (dba Lucky
Dog Creative™) and hereafter referred to as LDC, shall retain ownership
of all copyrights and the original artwork.
Cancellation of a project AFTER receipt of the first set of
concepts/drafts due to dissatisfaction with the quality of creative
delivered will fall under LDC’s Guarantee Policy.
Ownership and Return of Artwork
Customer will retain ownership and copyright of all final art produced
and selected by Customer upon complete payment of all outstanding fees.
LDC retains ownership of all original artwork (concept, ideas, copy,
layout, illustrations, artwork, etc.) of all artwork not selected by
the Customer. Customer agrees to destroy and not reference or use in any
format or by any means, any electronic formats of such artwork (e.g.,
PDF's, TIFF's, GIF's, Quark files, etc.) within 30 days of review and
upon selection and receipt of final artwork files.
Limitation on Use
Customer agrees not to manufacture, sell, deal in, or otherwise use or
appropriate the disclosed Information (concepts, samples, comps, copy,
content, etc.) in any way whatsoever, including but not limited to
adaptation, imitation, redesign or modification. Nothing contained in
this agreement shall be deemed to give the Customer any rights whatsoever
to the information. Customer has an unlimited, unrestricted use of all
final, selected artwork. Ads, concepts, strategies, etc. offered to the
Customer by LDC but not chosen by the Customer must be destroyed and follow
the terms described above.
Warranty of Originality
LDC warrants and represents that, to the best of their knowledge, the
work assigned herein is original and has not been previously published,
or that consent to use has been obtained on an unlimited basis; that
all work or portions thereof obtained through the undersigned from
third parties is original or, if previously published, that consent to
use has been obtained on an unlimited basis; that LDC has full
authority to make this agreement; and that the work prepared by LDC
does not contain any scandalous, libelous, or unlawful matter.
Customer is responsible for proofing, providing revisions to LDC and approving all Final Artwork and is responsible and liable for all copy, imagery and contents within any Final Artwork. Once Customer approves Final Artwork, LDC is not held liable for any errors and omissions in Final Artwork. All usage of Final Artwork is the sole responsibility and liability of the Customer.
This warranty does not extend to any uses that the Customer or others may
make of LDC’s product that may infringe on the rights of others. The
Customer expressly agrees that it will hold LDC harmless for all
liability caused by the Customer's use of LDC’s product to the extent
such use infringes on the rights of others.
LDC is not held liable for any work, policies, product, or services obtained by Customer from any of LDC's preferred partners.
*Lucky Dog Creative Boutique Terms of Use will be outlined in an individual agreement between LDC and the customer.
